This is one of the few NIL questions with a direct answer
The Schedule E instructions now speak to student-athletes by name. Monetary or financial gain from NIL, including non-cash compensation, is income. NIL income from sponsorships or services goes on Schedule C. NIL that is royalty income and not self-employment income goes on Schedule E. IRS
| Payment | Taxable? | Where it goes | Self-employment tax? |
|---|---|---|---|
| Brand or sponsor cash | Yes | Schedule C | Usually yes |
| Appearances, camps, autographs, social posts | Yes | Schedule C | Usually yes |
| Products, gear, cars or housing as NIL pay | Yes, at fair market value | Schedule C | Usually yes |
| Collective payments for services or promotion | Yes | Schedule C | Usually yes |
| True royalty for name or likeness with no services | Yes | Schedule E | Not if it is royalty income that is not self-employment income |
| School revenue-share payment | Yes, unless excluded by a specific rule | Depends on classification | Unsettled. See below |
NIL Tax Forms and 1099 Income
A missing form does not mean missing income
For 2026 payments, a payer files Form 1099-NEC when it pays you $2,000 or more for services, and royalty reporting starts at $10. IRS Plenty of small deals fall under $2,000, and plenty of local businesses never send a form. You still report the money.
Keep one running list with the deal, the date, cash received, the value of any product, and any form that arrives. Open a separate bank account if you can, even with a modest number of deals. If you want to see how much money should stay out of your spending account, our guide on how much to set aside for 1099 taxes walks through it.
Free Products and In-Kind Pay
The tax bill that arrives without any cash
Income can come in any form: money, property or services. Treas. Reg. 1.61-1 When a dealership lends or gives you a car, or a brand sends gear in return for posts, the amount you report is generally its fair market value. IRS Value is what it would sell for, not what the brand says it cost.
A vehicle "loan" needs a close look at who holds title, how long it lasts and what you do in return. Ask for the value and the terms in writing, up front.
Self-Employment Tax and Quarterly Estimates
Nobody withholds this for you
Self-employment tax is 15.3%, applied to net earnings of $400 or more. IRS Age and student status do not change that, and this is often the surprise on a first return, since it applies well below the point where income tax begins. See our full guide to self-employment tax.
If you expect to owe $1,000 or more when you file, you generally need to pay during the year. You avoid the underpayment penalty by paying at least 90% of this year's tax or 100% of last year's, and the prior-year test is 110% if your adjusted gross income was over $150,000. IRS IRC 6654 Payments are due April 15, June 15, September 15 and January 15. IRS A big deal late in the year may fit better with the annualized method described in our quarterly tax guide.

Deductions
Business costs reduce both taxes. Personal costs reduce neither
Schedule C income is net of ordinary and necessary business costs, so each dollar you can deduct lowers income tax and self-employment tax. The line to watch: a cost has to be for the NIL business, not for being a student or an athlete generally.
| Cost | Typical treatment |
|---|---|
| Agent and marketing fees | Deductible when paid for NIL work |
| Attorney and tax help for NIL deals | Deductible for the business part |
| Phone, video and editing tools | Business-use share only |
| Travel to a paid appearance or shoot | Deductible, with meals generally limited to 50% |
| Merch you pay to make and sell | Deductible as a cost of the goods |
| Training, meals and gear you would use anyway | Usually personal. Be careful here |
Collectives and School Revenue Sharing
One is largely clear for you. The other is not
Collectives. An IRS Chief Counsel memo, AM 2023-004, concluded many NIL collectives do not qualify as tax-exempt because they serve the private interest of athletes. IRS That memo is about the collective and its donors. From your side, payment for services or promotion is income, whatever the collective's status. A payment labeled a gift or a grant deserves a close read, because labels do not decide this.
School revenue sharing. Since the House v. NCAA settlement was approved in June 2025, schools opting in can pay athletes directly. CRS As of this review, we have not found IRS guidance saying how those payments should be classified, and schools and advisers describe them in different ways: W-2 wages, 1099 income or royalties. That choice changes who withholds and whether self-employment tax applies.
Unsettled: how revenue-share payments are classified
Do not assume the answer from a teammate's deal. Read what your agreement says you are being paid for, and check which form your school intends to issue. If it is a 1099, plan to pay estimates yourself. Whichever form you get, keep the agreement, since this area may change.Scholarships and Your Parents' Return
Two separate questions families often combine
Scholarships. For a degree candidate, a scholarship used for tuition, required fees and required books is tax free. Amounts used for room, board and travel are taxable, and so is pay for services required as a condition of the grant. IRS Pub. 970 Separate that from NIL income.
Dependency. A parent can generally claim a full-time student under 24 as a qualifying child only if the student did not provide more than half of their own support. Scholarships for study are left out of that test. IRC 152 So what matters is what the student spends, not just what the student earns. Add up housing, food and other support, and compare who paid.
Your standard deduction. If you can be claimed, your 2026 standard deduction is the greater of $1,350 or your earned income plus $450, capped at the regular $16,100. Rev. Proc. 2025-32 Self-employment NIL income counts as earned income, so most athletes with real deals reach the full amount, and the kiddie tax is aimed at unearned income rather than pay for your own work.
A Worked Example
Hypothetical college athlete, round numbers, 2026 federal tax
Illustrative example: $40,000 in cash plus $10,000 in products
This athlete is not a real person. Single filer, claimed as a dependent, full standard deduction. $8,000 of agent fees and business costs.
| NIL income: cash plus product value | $50,000 |
|---|---|
| Business costs | ($8,000) |
| Net Schedule C income | $42,000 |
| Self-employment tax (15.3% of 92.35%) | $5,934 |
| Adjusted gross income after half of that tax | $39,033 |
| Standard deduction | ($16,100) |
| Qualified business income deduction, limited to 20% of taxable income | ($4,587) |
| Taxable income | $18,346 |
| Federal income tax | $1,954 |
| Total federal tax | $7,888 |
That is about 19% of net income, or roughly $1,970 each quarter. Most of it is self-employment tax, and only $40,000 of the income came in as cash. State income tax is on top and depends on where the athlete lives and where the work was done.
Should a college athlete form an S corp? Usually not this early. Payroll, a corporate return and state fees eat up most of the benefit at this level. As income grows, our LLC vs S corp guide shows how to think about it. Athletes headed to a pro career should look ahead at athlete tax planning and the jock tax. Frequently Asked Questions
Is NIL money taxable?
Yes. The IRS says a student-athlete's monetary or financial gain from name, image and likeness, including non-cash compensation, is income. Income from sponsorships or services goes on Schedule C. NIL that is truly royalty income, not self-employment income, goes on Schedule E.
Do NIL athletes pay taxes?
Yes, if they earn enough to file. Net self-employment earnings of $400 or more trigger self-employment tax and a return, even for a student claimed as a dependent. Most NIL income also carries income tax, and state tax can apply where the athlete lives and where the work was done.
Are free products from an NIL deal taxable?
Generally yes when received in exchange for promotion or services. The IRS instructions for student-athletes include non-cash compensation, and you report the fair market value. So you can owe tax on a car or gear without having received cash to pay that tax.
Will I get a 1099 for NIL income?
Many payers will send Form 1099-NEC if they pay you $2,000 or more for 2026 work. Some will not. You owe tax on the income either way, so keep your own record of every deal, payment and product received.
Can my parents still claim me if I earn NIL money?
Possibly. Under the qualifying child rules a full-time student under 24 can be claimed if the student did not provide more than half of their own support. NIL income itself does not end that, but spending it on your own support can. Scholarships for study do not count as support you provided.
Does NIL income affect my financial aid or eligibility?
We do not cover that here. This guide is tax only. Ask your school's financial aid and compliance offices about aid, NCAA, conference and state rules before you sign.
